Policy Guidelines:

Requirements:

  • Surveillance is conducted when there are reasonable grounds of fraudulent activity, and when other methods have been utilized but have found to be ineffective.
  • The person requesting the surveillance should weigh and balance the need of the surveillance to the privacy interests of the claimant.

Our clients should consider the following:

  • Are there reasonable grounds to suspect fraudulent activity or a violation of the applicable Acts or laws by the claimant and/or plaintiff or defendant.
  • If so, what are the reasonable grounds? What evidence do you have to retain a surveillance?
  • Will the potential information or evidence gathered from the surveillance, outweigh the privacy rights associated with the claimant?
  • What is the potential impact of surveillance? Is there any adverse risks to the surveillance?
  • Can the information be obtained by any other means?

Criteria for Investigation:

  • We will require the means for identifying with the claimant and the purpose of the surveillance.
  • Photographs are ideal as we can attach them as an exhibit as a means of identifying with the claimant.
  • We will require a description of the target, if photographs are not available.
  • We will require the address,make model & license plate of the vehicles driven by the claimant or subject.
  • We will require a time frame of the surveillance.

Video:

  • We will videotape the claimant's activities, and route if necessary;
  • We will only videotape when it is reasonable to do so and required by evidence;
  • When we transfer the Hard Disk Drive video onto our computers, we will need to ensure your capability to view the DVD-R in our format. Our video is formatted in MPEG 1.
  • We can also burn the HDD recording onto a DVD burner, or DVD recorder and send to you via email immediately following the surveillance. There is no wait time in both formats, unlike other investigation companies that take up to 5-10 days to deliver results. For DVD-R's, we will need to ensure compatibility.
  • Video copied on CD-R can be viewed by any computer, but the capacity of video is limited. It has a storage capacity of 74 minutes or 700 MG. of data.
  • The videos will be labeled with the clients' name, file number, our company name, claimant's name, investigator, and the date and time of the video footage;
  • All videos will cite the date and time images were copied onto CD-R's to record the continuity of evidence for court.
  • We will provide a report of the surveillance attaching the videotape as an exhibit. This can be emailed if this is an urgent matter.
  • Our videos will have the date and time referenced.
  • All video will be transferred in its entirety on DVD-R or CD-R.
  • We will maintain a copy of the original image/s for a period of seven years and/or until required by law.

Night Surveillance:

  • Using infrared emitters, we are able to provide video in total darkness.

 

Camera Phones:

Our smartphones come with a built in 1.3 megapixel camera with a 2x digtial zoom, including the capability to take video. We can upload to our computer and email the results. We also have audio recording capability.

 

Reports:

  • Our reports record an objective narrative of the facts;
  • All our reports and video submitted by email are virus free.
  • Our format includes the assignment instructions, means for identifying the claimant, and summary of the detailed events on a daily basis.
  • Daily updates are provided to our clients as well.

 

Laws:

We will not obtain any information by methods that contravene any provincial or federal laws, including but not limited to, the following:

  • The Criminal Code;
  • The Federal Privacy Act;
  • The Private Investigators & Security Guards Act;
  • The Worker's Compensation Act;
  • Human Rights Code;

 

Restrictions of Surveillance:

  • We will not accept from or pressure any public or private employee/s to provide any information that would violate their confidentiality to their employers.
  • All investigations will be carried out in confidential manner and only having regard to the purpose of the surveillance. If the target suspects he/she is followed, we must cease the surveillance and advise our client immediately.
  • We will not enter on private property of the claimant that is under surveillance, except where the property is being used for commercial purposes, for the benefit of an undercover operation.
  • We will not videotape inside a residence.
  • If there is a conflict of interest and/or perceived conflict of interest, we must advise the client and provide no further information.

Allowances of a Surveillance:

We will conduct a surveillance:

  • When the claimant is leaving his/her home;
  • When the surveillance is out in the public;
  • When there is no reasonable expectation of privacy;
  • We will document the locations, addresses, and vehicles driven by the claimant.
  • When video footage is not obtained, we will clearly document the activities observed.
